Who qualifies for a family-based green card?
Immediate Relatives: This category is for close relatives of U.S. citizens, such as spouses, unmarried children under 21, or parents. There is no limit on the number of visas available in this category.
Family Preference: This category is for more distant relatives of U.S. citizens and some relatives of lawful permanent residents (green card holders). The number of visas available in this category is limited each year. It includes:
- Unmarried children (21 years of age or older) of U.S. citizens
- Spouses and unmarried children (under 21) of lawful permanent residents
- Married sons and daughters of U.S. citizens
- Brothers and sisters of U.S. citizens (if the U.S. citizen is 21 or older)
General requirements for employment-based immigration
A valid job offer in the U.S.: The offer must be from a U.S. employer who is willing to sponsor you.
Qualifications for the job: You must possess the necessary education, experience, or skills for the offered position.
Labor Certification (PERM) for some categories (EB-2 and EB-3): This process verifies that there are no qualified U.S. workers available for the job and that hiring you won’t adversely affect U.S. workers’ wages and working conditions (exceptions apply).
General requirements for naturalization
Age: You must be at least 18 years old at the time you file your application.
Lawful Permanent Resident (LPR) Status: You must have held a green card for a specific period of continuous residency. Generally, this is:
5 years: For permanent residents who have been married to a U.S. citizen for at least 3 years.
3 years: For all other permanent residents.
Physical Presence: You must have been physically present in the United States for a certain amount of time during your residency period. This typically translates to:
At least half (2.5 years) of the 5 years preceding your application (if applying based on 5 years of green card residency).
At least half (1.5 years) of the 3 years preceding your application (if married to a U.S. citizen).
Good Moral Character: You must demonstrate good moral character by having a clean criminal record and following the laws.
